Facts
After more than eight years of litigation, TruConnect, a telecommunications provider, achieved a complete victory in a representative PAGA action filed by a former retail sales associate who worked for the company briefly in late 2017. The plaintiff, Lizbeth Guerrero, alleged that TruConnect failed to provide compliant meal and rest breaks and did not properly pay overtime.
Result
Following a four-day bench trial in June 2025 and post-trial briefing, Los Angeles Superior Court Judge Carolyn B. Kuhl issued a ruling on September 16, 2025, concluding that TruConnect had lawfully provided Guerrero with the opportunity to take meal and rest breaks and had properly paid her overtime. The Court found that Guerrero failed to prove she had personally experienced any Labor Code violations. As a result, she was not considered an "aggrieved employee" and lacked the standing to pursue PAGA claims on behalf of others. Judgment was entered entirely in favor of TruConnect.
