Appeals 

In addition to being trial attorneys, we draw upon our federal appellate clerkship experience to serve as appellate counsel in a wide array of cases.  We have achieved success in appeals upholding favorable lower court rulings, as well as overturning adverse rulings.

The firm’s recent successes at appellate litigation include:

  • Stein v. Black Diamond Supplements (Cal. Ct. App., B308482): successfully reversed a judgment of dismissal in a case that alleged a muscle building compound contains a chemical known to cause cancer (Androstenedione) without the warning required by Proposition 65 appearing on the packaging.

  • Dr. V Productions v. Rey (Cal. Ct. App., B312605): successfully dismissed appeal from an order denying motion for $273,484.56 in attorneys’ fees under Civil Code section 3426.4 (providing for attorneys’ fees for the bad faith prosecution of a trade secret misappropriation claim).

Other successes in appellate litigation experienced by the lawyers of KJC Law Group prior to their time with the firm include:

  • Affirming judgment of $537 million and assets valued in excess of $1 billion in dispute over family ownership of multinational energy company (Tx. Ct. App. First Dist.).

  • Reversing summary judgment in foreclosure action for possession brought by major financial institution (Cal. Ct. App.).

  • Reversing judgment due to trial court’s misapplication of California Probate Code section 6402.5, a statute that provides the circumstances under which the portion of the decedent’s estate attributable to a decedent’s predeceased spouse may be distributed to certain relatives of the predeceased spouse (Cal. Ct. App.).
